Yamada Consulting Group, Co., Ltd. and its affiliated companies listed here (“Company”, “we”, “our”, or “us”) commit to protecting the privacy and the confidentiality of your personal data. In this Privacy Policy, we explain the purposes of collecting, use, and disclosure of your personal data as well as how we have ensured that you have adequate control over your personal data.

1 - Compliance with Laws and Regulations
The Company complies with any applicable laws and regulations that may apply to the handling and protection of personal data by the Company.


2 - Collection of Personal Data
Upon collecting your personal data, the Company specifies the intended use of the data to the best of its ability and complies with all applicable laws and regulations.

The Company collects the following categories of personal data. Your name, telephone number, home address, e-mail address, company name, title or position, cookie and other online identifier, date of birth, nationality, education and qualification details, your gender, your CV, photograph, passport number, marital status, other details set out in your application, responses to questionnaire, inquiry details and any other information you provided to us.


3 - Sources of Personal Data
The Company may obtain your personal data directly from you or any other source, including, but not limited to the following:

  • (a) provided directly by you when we are establishing a business relationship with you, including information obtained by business card exchange and submitted by you in various documents; and/or
  • (b) provided when you respond to questionnaires or surveys or when you communicate with us through phone calls, emails, and/or other correspondence.

In the event that you provide any personal data to the Company on behalf of other persons, it is your responsibility to confirm that they have consented to the processing and transfer of their personal data in accordance with this Privacy Policy (if necessary), and you shall be authorized to receive any privacy notice and other related information on their behalf. In the event that you provide a minor’s personal data, you shall obtain consent from his/her parent or legal guardian.


4 - Obligation to Provide Personal Data In general, providing your personal data shall be made voluntary. In some cases, however, the Company may need your personal data; for example, when we enter into a contract with you. In such case, your refusal to provision of your personal data may cause us impossible to enter into a contract with you or provide any other services relating to your personal data.


5 - Legal Grounds and Purposes of Use of Personal Data
The Company shall only use your personal data when supported by appropriate legal grounds under the applicable laws and regulations within the scope of the following purposes of use.

  • (a) To provide consulting and related services;
  • (b) To provide guidance/information on products and services by the Company or its business partners;
  • (c) To provide guidance/information on after-sale follow-up services by the Company or its business partners;
  • (d) To provide guidance/information on seminars sponsored or co-sponsored by the Company or its business partners;
  • (e) To send required materials, inquiries, or questionnaires;
  • (f) To search for a counterparty with regard to leasing, buying, selling, or managing of real estate, to enter into a contract for sale, lease, brokerage, or management of real estate, or to provide services based on such a contract
  • (g) To respond to a client's intention including proceeding with inheritance procedure;
  • (h) To submit attendance records to qualification bodies;
  • (i) To develop new products and improve services;
  • (j) To recruit personnel
  • (k) To reply to inquiries;
  • (l) To use such information within the scope of prior consent from you
  • (m) To improve your online activities based on your online identifier.


6 - Disclosure of Personal Data
For the purposes stated in “5. Legal Grounds and Purposes of Use of Personal Data”, the Company may disclose your Personal Data:

    The Company utilizes Google Analytics, a web analytics service provided by Google, to understand your use of the website. Google Analytics applies cookies to collect, record, and analyze how you browse the website. The information is managed by Google in accordance with its privacy policy. 7 - Security Management Measures
The Company takes the following security management measures for personal data.

  • 1 - Establishment of Privacy Policy
    In order to ensure the proper handling of personal data, the Company has defined basic rules on relevant matters, including compliance with applicable laws and regulations.
  • 2 - Establishment of Rules
    The Company has established rules on handling methods, persons in charge, its duties, and other relevant matters at each stage of collection, use, storage, provision, deletion, and disposal of personal data, and periodically reviews them.
  • 3 - Organizational Security Management Measures
    In addition to appointing a person responsible for the handling of personal data, the Company has clarified its officers/employees, and the scope of personal data handled by such officers/employees, and has established a system to report to the responsible person when an officer/employee is aware of any facts or signs that violate laws and regulations. The Company conducts periodical self-inspections and audits on the handling of personal data.
  • 4 - Human Security Management Measures
    The Company conducts periodic training for officers/employees on the handling of personal data, incorporates confidentiality obligations in the Company's Rules of Employment, and makes them aware within the Company.
  • 5 - Physical Security Management Measures
    In areas where personal data is handled, the Company controls the entry and exit of officers/employees and equipment, and implements measures to prevent unauthorized persons from viewing personal data. In addition to taking measures to prevent theft or loss of equipment and electronic media that handles personal data, the Company has implemented measures to prevent the easily revealing of personal data when carrying such equipment and electronic media.
  • 6 - Technical Security Management Measures
    The Company has introduced a system to limit the scope of officers/employees and the scope of personal data handled by such officers/employees by controlling access, and to protect information systems that handle personal data from external unauthorized access or software.


8 - Continuous Improvement
The Company shall strive to protect personal data by continuously improving its handling of personal data.


9 - Transfer of Personal Data to Foreign Countries
The Company may transfer personal data outside of your countries of residence. These countries may not have personal data protection laws as comprehensive as those that exist in your country of residence, and the same level of protection as that set forth in the personal data protection laws in your country may not necessarily be guaranteed. In such case, the Company shall implement necessary safety management measures pursuant to the requirements of the applicable laws.


10 - Retention Period
Your personal data will be stored securely in the Company’s data server or in a third party’s data server. The Company will strictly control access to personal data and will review such access control from time to time. The Company will retain and use your personal data until the purpose of processing of personal data is achieved. When the purpose is achieved, such personal data will be destroyed without delay.

The Company may retain the personal data for a longer period if it is necessary, provided, however, your personal data will never be kept for longer than required for the purpose of which it has been collected or processed, in accordance with the applicable laws or legislations.


11 - Data Subjects’ Rights
With respect to personal data managed by the Company, you have certain rights pursuant to the applicable laws and regulations, which may include the following rights of the data subject:

  • (a) the right to be informed (the right to be informed about the details such as the identity of the controller, the purposes of the processing, legitimate interests pursued by the controller, and when the controller collects personal data);
  • (b) the right of access (the right to obtain from the controller confirmation as to whether or not your personal data is held);
  • (c) the right to rectification (the right to obtain from the controller without undue delay the rectification of your inaccurate personal data);
  • (d) the right to erasure (the right to obtain from the controller the erasure of your personal data);
  • (e) the right to restrict processing (the right to obtain from the controller restriction of processing);
  • (f) the right to data portability (the right to receive your personal data, which you have provided to a controller, in a structured, commonly used and machine-readable format and the right to transmit to another controller without hindrance from the controller);
  • (g) the right to object (the right to object, on grounds relating to your particular situation, at any time to processing of your personal data, including the rights to withdraw the consents to process personal data.);
  • (h) the rights in relation to automated decision making and profiling (the right not to be subject to a decision based solely on automated processing, including profiling):
  • (i) the rights to demand data confidentiality;
  • (j) the rights to file a complaint with the Ministry of Information and Communication when personal data is handled illegally (in violation of confidentiality obligations).

12 - Privacy Policy Updates
The Company reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. However, if at any time in the future the Company plan to use your personal data in a way that materially differs from this Privacy Policy, the Company will post such changes here or otherwise notify you in a manner that complies with applicable laws and regulations. The Company encourage you to periodically review our website for the latest information on our privacy practices.

Privacy Policy for California Residents
This Privacy Policy for California Residents (this “California Privacy Policy”) conforms to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (the “CCPA”). This California Privacy Policy supplements the information contained in our Privacy Policy. This California Privacy Policy applies to the processing of the information that identifies, relates to, describes, references, and is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”) of consumers who are residents of California (“you”, or “your”). In the event of a conflict between the Privacy Policy and this California Privacy Policy, this California Privacy Policy will prevail as to your Personal Information and rights under the CCPA.


1 - Categories of Personal Information Collected
The Company will collect, and has collected in the last twelve (12) months, the following categories of Personal Information from you for the purposes described in the Section 5 (Legal Grounds and Purposes of Use of Personal Data) of the Privacy Policy:

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). Name, address, telephone number, date of birth, passport number, credit card number, debit card number, and other financial information.
C. Characteristics of protected classifications under California or federal law. Gender, marital status and national origin.
D. Commercial information Inquiry details, responses to questionnaire, products and services purchased, and other inquiring or purchasing histories.
E. Professional or employment-related information. Name, date of birth, nationality, education and qualification details, gender, CV, photograph, passport details, marital status, home address and home telephone number, mobile telephone number and other details set out in your application.


2 - Categories of Sources of Personal Information
The Company has collected each category of Personal Information listed above from sources described in the Section 3 (Sources of Personal Data) in the Privacy Policy.


3 - Disclosure of Personal Information
The Company may disclose your Personal Information to a third party for business purposes or commercial purposes. When the Company discloses your Personal Information to service providers or contractors for business purposes or commercial purposes, the Company enters into a contract that describes such purposes and requires the service providers or contractors to keep such Personal Information confidential and to not use the same for any purpose except for performing the contract.

In the preceding twelve (12) months, the Company has disclosed each category of Personal Information listed above to third parties described in the Section 6 (Disclosure of Personal Data) in the Privacy Policy.


4 - Sale or Sharing of Personal Information
The Company has not sold or shared your Personal Information in the preceding twelve (12) months that the Company has collected from you.


5 - Your Rights and Choices under the CCPA
The CCPA provides consumers who are residents of California with specific rights regarding Personal Information. The following parts of this Section describe your rights and explain how to exercise those rights under the CCPA.

  • 1) Right to Access Specific Information
    You have the right to request that the Company discloses certain information to you about our collection, sharing, disclosure or use of your Personal Information over the past twelve (12) months from the time of your request. Once the Company receives and confirms your verifiable consumer request, the Company will disclose to you the following information:
    • (a) The categories of the Personal Information the Company collected about you;
    • (b) The categories of sources of the Personal Information the Company collected about you;
    • (c) Our business or commercial purpose for collecting, selling or sharing that Personal Information;
    • (d) The categories of third parties with whom the Company discloses, sells or shares that Personal Information;
    • (e) The categories of Personal Information disclosed, sold or shared with each third party; and
    • (f) The specific pieces of Personal Information the Company collected about you.
  • 2) Right to Request Deletion
    You have the right to request that the Company deletes any of your Personal Information that the Company collected from you and retained, subject to certain exceptions. Once the Company receives and confirms your verifiable consumer request, the Company will delete (and notify our service providers or contractors and third parties to whom the Company has sold or shared such Personal Information to delete) your Personal Information from our records, unless an exception applies. The Company may deny your deletion request if retaining the information is necessary for the Company or our service providers or contractors to:
    • (a) Complete the transaction for which the Company collected the Personal Information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
    • (b) Help to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes;
    • (c) Debug products to identify and repair errors that impair existing intended functionality;
    • (d) Exercise free speech, ensure the rights of other consumers to exercise their free speech rights, or exercise other rights provided for by law;
    • (e) Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
    • (f) Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the ability to complete such research, if you previously provided informed consent;
    • (g) Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with the Company and compatible with the context in which you provided the information; or
    • (h) Comply with legal obligations.
  • 3) Right to Request Correction
    You have the right to request that the Company corrects any of your inaccurate Personal Information that the Company collected from you and retained, subject to certain exceptions. Once the Company receives and confirms your verifiable consumer request, the Company will correct (and notify our service providers or contractors and third parties to whom the Company has sold or shared such Personal Information to correct) your inaccurate Personal Information. The Company may deny your correction request if we determine that the contested Personal Information is more likely than not accurate based on the totality of the circumstances.
  • 4) Opt-Out Rights
    The Company has not sold or shared and will not sell or share your Personal Information that the Company has collected from you.
  • 5) Non-Discrimination
    The Company will not discriminate against California residents for exercising any of their rights under the CCPA. Moreover, unless permitted by the CCPA, the Company will not:
    • (a) Deny you goods or services;
    • (b) Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
    • (c) Provide you a different level or quality of goods or services; or
    • (d) Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services; or
    • (e) Retaliate against an employee, applicant for employment, or independent contractor.
  • 6) Exercising Access, Deletion and Correction Rights
    To exercise the access, deletion and correction rights described above, please submit a verifiable consumer request to the Company by contacting the Company in the manner set forth in the Section 6 (Contact Us).

    Only you, or a natural person or a person registered with the California Secretary of State that you authorize to act on your behalf, or a person who has power of attorney or is acting as a conservator for you, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.
    The verifiable consumer request must:
    • (a) Provide sufficient information that allows the Company to reasonably verify you are the person about whom the Company collected Personal Information or an authorized representative (e.g. name, email address, company name, Driver’s License or another license); and
    • (b) Describe your request with sufficient detail that allows the Company to properly understand, evaluate, and respond thereto.
